Nolan Donald Grove was charged as an adult, and has also been charged with a felony of having a firearm without a license and multiple misdemeanor counts of possession of a firearm by a minor, and recklessly endangering another person. He surrendered Friday, May 5, 2023, according to York County District Attorney Dave Sunday. If he is convicted he would face a maximum sentence of 40 years.
Kain Heiland was pronounced dead at 9:48 p.m. on Saturday, April 1, 2023, by York County Deputy Coroner Scott Pennewell, according to a release by the office the following day.
Kain was later identified by a family friend, which has been verified by Daily Voice.
Nolan made allegedly made a joke about Kain's mom, who told him to shut up, and the 13-year-old responded by shooting Kain in the back, authorities explained.
A .380-caliber shell casing was found near Heiland’s body, state police said. Nolan's father owns a .380-caliber gun but he has not been charged.
Nolan has been denied bail and will be housed in a juvenile facility, authorities said at a press conference. His preliminary hearing has been scheduled before Magisterial District Judge John H. Fishel at 1 p.m. on June 27, 2023, according to his court docket.
Kain's family friend, Terrica Agosto launched a GoFundMe campaign to help his family.
She explained that he "was spending the night at a friend's house and a nightmare happened accidentally and she lost her oldest son Kain in a sue to a gunshot wound."
The money raised by the campaign will "help support Devin Rexroth, her fiance Kevin, and Kain's dad Brian Heiland and Emily with the costs they will all need to cover his funeral arrangements."
